Disclaimers and Warranties

This document sets out the disclaimers made and warranties provided by RollsPack Pty Ltd ACN  174 349 603 (“RollsPack” or “we”) in connection with the Fire-SAFE Emergency Bag™ fire retardant bag (“the Bag”).

Fire-SAFE Emergency Bag Disclaimer

It is important to note that the Bag is fire retardant, but not fireproof.  It is designed to protect its contents  against high temperatures and moisture, but if these exceed certain limits, the contents could become damaged or destroyed, thereby exposing the contents to risk of damage or destruction.  We advise you to store the Bag in a location where you can easily locate, access and remove it in the event of any emergency. If you leave your Bag at your premises during an emergency, store it in a metal fire safe to protect it and its contents.

Your decision to purchase and use the Bag should not be a substitute for taking all other reasonable and necessary precautions to protect the proposed contents of the Bag, including, without limitation, maintaining insurance covering damage, destruction and/or theft.

To the extent permissible at law we disclaim all liability associated with any loss or damage (including consequential loss and damage) occasioned through your use of the Bag. 

 

Fire-SAFE Emergency Bag Refunds

RollsPack will provide a refund in the event that your Bag is not of acceptable quality (as defined by the Australian Consumer Law).  Acceptable quality means that the product is fit for the purposes it is commonly supplied, acceptable in appearance and finish, free from defects and is safe and durable.  Please note that we do not provide refunds in the event consumers change their mind about the purchase.

 

Fire-SAFE Emergency Bag Express Warranty

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The benefits provided under our express warranty are in addition to any that may be required under the Australian Consumer Law.

 

What Is Covered by Our Express Warranty

Our Express Warranty covers the Bag for a period of two years from the date of purchase.  If the law requires a longer warranty in any given situation, we will provide that warranty.

Without limiting any guarantees that cannot be excluded at law, the   Express Warranty covers defects in structure or materials that were caused during manufacturing or during transport of the Bag.

 

What Is Not Covered

The  Express Warranty (and to the extent permissible at law, all other implied warranties) do not cover any damage caused by the consumer from modifying, attempting to fix, or otherwise alter the Bag, if such action causes the product to become of unacceptable quality or constitutes abnormal use.  To the extent permitted at law we exclude all liability for any such damage.  

 

Who Is Covered by the Express Warranty

The Express Warranty can only be claimed by the original purchaser of the Bag. The  Express Warranty is not transferable to subsequent owners or purchasers of the Bag.  However, the mandatory guarantees under the Australian Consumer Law apply to all consumers of the Bag.

 

How To Make A Warranty Claim

In the case of a warranty related issue please contact customerservice@rollspack.com.au and provide details of your claim, including any photographs depicting the defect in question if, acting reasonably, we consider the defect to be covered by our Express Warranty or otherwise, we will require you to send us the Bag in question for our inspection at your expense.  Assuming that we accept your warranty claim, we will refund, via the payment method you used to purchase the Bag, your reasonable postage costs associated with sending it to us.

 

What RollsPack Will Do

In the event we agree that a Bag is defective and covered by the warranties in this document, we will, at your election:

1.      Replace the Bag with a new one and cover shipping costs to get it to you; or

2.      Issue a refund for the Bag.

 

Limitation On Liability

 

Except if and as required under the Australian Consumer Law, RollsPack shall not be responsible for any incidental or consequential damages.
